One which is considered by the parties to be capable of settlement by adjudication - that is, by arbitration or judicial settlement. In principle, any dispute can be settled on this basis. But if the core of the dispute is not about the application or interpretation of existing international law but reflects dissatisfaction with it, resort to adjudication will not provide a real settlement. Nor will it do so unless each of the parties is willing to apply an adverse judgment. Justiciable disputes are sometimes known as legal disputes. See also non-justiciable dispute. |
