Established by the Hague Conferences of 1899 and 1907 the PCA is, as has often been said, neither permanent nor a court. Rather, it consists of a list of arbitrators (nominated by the parties to one or other of the Hague conventions regarding the PCA). When a dispute is submitted to it, each of the parties selects two arbitrators from the list (only one of whom may be its own national (sense 2) or from the arbitrators it placed on the list), and they select a fifth. The award is given by majority vote. The PCA has not been much used since about 1930, but its Bureau has been active in facilitating ad hoc arbitration. |
