A qualification made by a party to a treaty, resolution, or consensus statement purporting to exclude itself from the operation of a particular provision of the treaty. In principle, the validity of a reservation depends on the consent of the other parties. But in practice the situation often becomes less than entirely clear. Nor is clarity in this area helped by the recent practice of ratifications and accessions being accompanied by interpretative declarations, which are not meant to have the legal effect of reservations but which sometimes seem, in the effect they are intended to have, to be little different from reservations. |
